Conditions of participation for events at the THEODOR-BILLROTH-AKADEMIE®

 

1. Organizer

THEODOR-BILLROTH-ACADEMY®, individual responsible: Prof. Björn Brücher, MD, Josephsburgstrasse 6, 81673 Munich, Germany

 

2. Area of application

These conditions of participation apply to all events and seminar-courses held by the organizer.

 

3. Registration and conclusion of contract

a) The contract shall come into force through registration and receipt of the organizer’s confirmation of participation. Confirmation of participation is provided by e-mail to the address given by the participant. The presentation of the event on the organizer’s web site does not represent a legally binding offer.

b) Registration can only take place through on-line registration. Whether or not participants can be included shall be decided by the organizer alone.

c) During on-line registration, clicking of the button “Registration” (“Anmelden”) represents a binding registration for the event described on the web page concerned. Confirmation of receipt of the registration shall be by automatic e-mail immediately after despatch of the order and does not yet represent acceptance of the contract.

d) Registration implies acceptance of the validity of these conditions of participation. If it is not possible for a registration to be taken into consideration, this will be communicated to the inquirer immediately.

 

4. Gratis participation

Participation in the events is free of charge.

 

6. Consumer revocation

As a consumer as specified under German law (German Civil Code, § 13 BGB), you have a right of revocation as follows:

Right of revocation You are entitled to withdraw your agreement to the contract within 14 days in writing (e.g., by post, e-mail) with no need to state reasons. The 14-day period begins on receipt of this explanation in written form, but not before conclusion of the contract and not before fulfilment of our duties of information in accordance with Article 246 § 2 in combination with the Introductory Law to the German Civil Code (EGBGB) § 1 Paras. 1 and 2 and our duties in accordance with § 312 g Para. 1. S. 1 BGB in combination with Article 246 § 3 EGBGB. Timely sending of the revocation is sufficient for the deadline for revocation to be met. Effects of revocation In case of valid revocation, any performance received by either party is to be returned and where applicable any benefits thereby accruing (e.g. interest) returned. If you are unable to return the performance or benefits received (e.g., benefits of use) in full or part or only in a damaged state, you must provide us with corresponding compensation. This may mean that you nevertheless have to meet contractually agreed payment obligations for the period up to the revocation. Obligations to reimburse payments must be met within 30 days. This period begins for you when you send your declaration of revocation and for us at the time we receive it.

Special notes Your right of revocation lapses prematurely if the contract has been fully met by both sides at your express wish before you have exercised your right of revocation.

 

7. Cancellation and changes in events by the organizer

a) The event may be cancelled by the organizer for good reason, particularly if there are insufficient numbers of participants, due to short-term unavailability of lecturers with no opportunity to find a replacement lecturer, or due to force majeure. The participant will be informed of this without delay. Claims for compensation by participants are excluded, subject to Clause 9.

b) The organizer is entitled to change lecturers or alter the schedule for good reason — e.g., due to illness on the part of a lecturer — so far as this is reasonable for the participant.

 

8. Cancellation by the organizer

The organizer may cancel the contract for valid reasons — e.g., if the participant continually disturbs the event.

 

9. Liability

The organizer is liable only for damage resulting from a deliberate or grossly negligent breach of obligation on the part of the organizer or his legal representatives or agents. Liability for injury to life, body and health or for infringement of major contractual obligations or the Product Liability Law is not affected by this. Major contractual obligations are those it is necessary to meet in order to fulfil the purpose of the contract and adherence to which the participant relies on and may normally rely on. In case of infringement of major contractual obligations, claims for compensation are limited to

 

10. Data protection

The participants’ data shall be used exclusively for the purposes declared in the Data Protection Declaration. Further information is available in the Data Protection Declaration.

 

11. Copyright

Work documents and the computer software used are protected by copyright. Copying these or passing them on to third parties is only permissible with prior agreement from the copyright owner.

 

12. Saving clause

If any individual clauses in these conditions should become invalid, the validity of the remaining clauses shall not be affected.

 

 

 

Data protection statement:

The THEODOR-BILLROTH-ACADEMY® takes the protection of your personal data very seriously. Our aim is to provide you with an easy-to-use online service while nevertheless upholding your right to information-related self-determination and ensuring the

protection of your private sphere. The following statement provides an overview indicating when we store what data, what purposes we use the data for, and the ways in which we ensure the protection of your personal data.

 

Collection and use of data

The THEODOR-BILLROTH-ACADEMY® collects personal data when you register on our web site. During registration, we ask you to give the following data: title, surname, forename, date of birth, intended career, private address and term-time address, university you are enrolled with, phone number, and e-mail address. We also ask you to provide us with a photograph. The data collected during registration are used for enrollment in our educational and further training seminar-courses and for conducting the courses. In addition, we also require these data in order to provide you with information material about our services. You may decline the sending of information material at any time — e.g., by sending us an e-mail. In addition, every time a user accesses a page from the THEODORBILLROTH-ACADEMY® web site, data concerning the process are stored in a log file. These data are only used for statistical analyses and are not linked to the personal data provided by the user.

 

In detail, the following data set is stored for each retrieval:

Name of the file retrieved

Date and time of the retrieval

Quantity of data transferred

Report on whether the retrieval was successful

Description of the web browser type used

Operating system used

IP address

The IP addresses are anonymized when the connection is closed. We are therefore not able to trace which user retrieved the data.

 

Transmission of data to third parties

The THEODOR-BILLROTH-ACADEMY® does not make any data it collects available to third parties. When you attend the seminar course, your address will be accessible to the other course participants through the list of participants. The lists of participants

are only for internal use by the THEODOR-BILLROTH-ACADEMY® and course participants — to enable you to organize car-sharing, for example.

 

Cookies

Our Internet pages use what are known as “cookies” at several points. These help make the site more user-friendly, efficient and safe. Cookies are small text files that are stored on your computer and locally in your Internet browser’s cache. Cookies do not harm your computer in any way and do not contain any viruses. The cookies we use are called “session cookies”: they are automatically deleted at the end of your visit to the site. These data are therefore not used for any continued identification of your visit to the web site. Most browsers are set so that they automatically accept cookies. You can deactivate cookie storage, but this will severely limit your usage of our Internet facilities (e.g., with regard to bookings and the personal area). You can also set your browser in such a way that it informs you about cookie setting or makes an exception for our Internet site.

 

Right to information and right of revocation

You can receive information at any time free of charge regarding your data that are stored with us. You can have the data that have been collected blocked, corrected, or deleted at any time and can decline the anonymized or pseudonymized data collection and storage that is used to optimize our web site. You can also at any time withdraw your permission for data to be collected and used, with no need to give reasons.
